Tyche is based in the United States and may provide services through personnel, systems, vendors, or infrastructure located in the United States, Mexico, or other jurisdictions identified in the applicable service agreement or sub processor list.


As a result, personal data may be stored in, accessed from, or processed in jurisdictions outside the state or country in which it was originally collected.


Where appropriate, Tyche will use contractual, organizational, and technical safeguards designed to protect data during cross-border processing, including:


  • Contractual data-protection obligations 
  • Confidentiality commitments 
  • Access restrictions 
  • Role-based access controls 
  • Multifactor authentication 
  • Encryption in transit and, where supported, at rest 
  • Logging and audit trails 
  • Restrictions on sub-processor access 
  • Incident-notification obligations 
  • Data-retention and deletion requirements 
  • Customer-approved geographic or residency restrictions when contractually supported 


The precise hosting and processing locations may depend on the platforms selected by the customer, including the customer’s Samsung Knox, Android Enterprise, Google, Microsoft, identity, cloud, or unified endpoint-management environment.

 The categories of data involved depend on the services purchased, the customer’s configuration, the device ownership model, and the functions enabled on each endpoint.


Data may include:


  • Device identifiers, serial numbers, IMEI numbers, hardware identifiers, and other technical identifiers 
  • Device inventory, ownership, enrollment, configuration, compliance, and operational-status information 
  • Operating-system, software, application, network, battery, and diagnostic information 
  • Telemetry and service-performance information 
  • IP addresses and approximate network-derived location information 
  • Precise or device-generated geolocation data when expressly enabled for authorized security, personnel-safety, asset-recovery, or business-continuity purposes 
  • Security logs and event records 
  • Alerts involving unauthorized access, configuration changes, policy violations, malware, device tampering, or attempted extraction of protected information 
  • Records of remote lock, wipe, quarantine, or remediation actions 
  • Names, business contact information, usernames, account identifiers, and roles associated with administrators, operators, or end users 
  • Information associated with enterprise accounts, managed profiles, applications, certificates, and security policies 
  • Support communications, incident records, and administrative audit logs 
  • Other information reasonably necessary to deploy, maintain, protect, troubleshoot, or support the contracted services 


Tyche seeks to limit the personal data it processes to information that is reasonably necessary, proportionate, and relevant to the contracted services and the customer’s documented instructions.


Where precise geolocation or other legally defined sensitive data is processed, Tyche and the customer will apply any consent, notice, authorization, or data-protection requirements imposed by applicable law and contractual terms and conditions.

Tyche’s role depends on the nature of the engagement.


Tyche as a Service Provider or Processor

In most managed-mobility engagements,.


Tyche processes personal data on behalf of and under the documented instructions of the customer.


In this capacity:


  • The customer determines the purposes and permitted uses of the data. 
  • The customer determines which device-management capabilities are enabled. 
  • Tyche processes the data only as necessary to deliver the contracted services. 
  • Tyche does not independently determine whether an employee or end user should be located, monitored, locked out, or subject to a remote wipe. 
  • Materially disruptive actions are performed only under documented authorization, established operating procedures, or an emergency-response process agreed with the customer. 


Tyche may act as an independent controller or business for limited purposes, such as:


  • Managing its own customer and partner relationships 


  • Maintaining business contact information 


  • Administering contracts, billing, and account records 


  • Protecting its systems and preventing fraud or misuse 


  • Meeting legal, regulatory, insurance, tax, or accounting requirements


  • Establishing, exercising, or defending legal claims 


When Tyche acts in this independent capacity, the applicable Tyche Privacy Notice governs the processing

Transferencias Internacionales y Remisiones de Datos Personales

 Tyche tiene su sede en Estados Unidos y puede prestar servicios mediante personal, sistemas, proveedores o infraestructura ubicados en Estados Unidos, México u otras jurisdicciones identificadas en el contrato de servicios aplicable o en la lista de subencargados. 


Para prestar y operar los servicios de administración, protección y seguridad de dispositivos móviles—incluyendo, según corresponda, el bloqueo o borrado remoto, la localización de equipos con fines de seguridad y recuperación, el monitoreo de eventos de seguridad, la administración de consolas y la aplicación de políticas a nivel de flotilla— determinados datos personales podrán ser:


Remitidos a proveedores que actúen por cuenta de Tyche como encargados o subencargados del tratamiento, o transferidos a terceros nacionales o extranjeros que actúen como responsables independientes, cuando ello sea necesario para cumplir las finalidades descritas en el presente Aviso de Privacidad. 


Datos que pueden ser objeto de remisión o transferencia


Dependiendo de la solución contratada, la configuración definida por la organización cliente y las funciones habilitadas en cada dispositivo, los datos involucrados podrán incluir:


  • Identificadores del dispositivo, números de serie, IMEI u otros identificadores técnicos. 
  • Información de inventario, configuración y estado operativo del equipo. 
  • Datos de telemetría y diagnóstico. 
  • Datos de geolocalización, cuando dicha función haya sido habilitada para fines legítimos de seguridad, protección de personal, recuperación de activos o continuidad operativa. 
  • Bitácoras y registros de eventos de seguridad, incluyendo alertas, intentos de acceso no autorizado, activaciones de bloqueo o borrado remoto y eventos relacionados con extracción, alteración o manipulación no autorizada del dispositivo. 
  • Datos de identificación y contacto de administradores, operadores o usuarios finales. 
  • Datos asociados a cuentas empresariales, perfiles administrados, aplicaciones y políticas de seguridad. 
  • Cualquier otro dato estrictamente necesario para prestar, mantener, proteger o dar soporte a los servicios contratados. 


Tyche procurará que los datos tratados sean adecuados, pertinentes y limitados a las finalidades informadas, conforme a los principios de proporcionalidad, finalidad y responsabilidad aplicables.


Fundamento y condiciones aplicables

De conformidad con los artículos 35 y 36 de la Ley Federal de Protección de Datos Personales en Posesión de los Particulares, Tyche realizará transferencias nacionales o internacionales únicamente cuando se cumplan las condiciones legales aplicables.


Cuando sea requerido, Tyche:


  1. Comunicará al tercero receptor el Aviso de Privacidad y las finalidades conforme a las cuales la persona titular autorizó el tratamiento de sus datos. 
  2. Exigirá que el tercero receptor asuma obligaciones de protección de datos personales equivalentes a las aplicables a Tyche. 
  3. Informará en el presente Aviso de Privacidad las categorías de terceros receptores y las finalidades de las transferencias. 
  4. Recabará el consentimiento de la persona titular cuando éste resulte legalmente necesario. 
  5. Podrá efectuar transferencias sin consentimiento cuando se actualice alguno de los supuestos previstos por el artículo 36 de la LFPDPPP, incluyendo, entre otros, aquellos casos en que la transferencia: 
    • Esté prevista en una ley o tratado aplicable. 
    • Sea necesaria en virtud de un contrato celebrado en interés de la persona titular. 
    • Sea necesaria para la salvaguarda de un interés público. 
    • Sea requerida para el reconocimiento, ejercicio o defensa de un derecho. 
    • Sea necesaria para el mantenimiento o cumplimiento de una relación jurídica entre la persona titular y el responsable. 


La legislación vigente establece que el tercero receptor debe recibir el Aviso de Privacidad y asumir las mismas obligaciones que correspondan al responsable que transfirió los datos. Asimismo, contempla supuestos específicos en los que la transferencia puede realizarse sin consentimiento

Tyche may deliver managed services through authorized personnel located in the United States and Mexico.


Tyche does not control the global cloud infrastructure architecture of third-party platforms such as Samsung Knox, Microsoft, Google, Android Enterprise Ecosystem or other customer-selected technology providers. 


The geographic location of platform hosting, backup, disaster recovery, technical support, and sub-processors may depend on:


  • The provider selected by the customer 
  • The customer’s licensing agreement 
  • The tenant region 
  • The service configuration 
  • The provider’s own infrastructure and privacy terms 
  • Any data-residency option purchased by the customer 



Where a customer requires specific geographic restrictions, U.S.-only access, Mexico-only access, named engineers, or defined data-residency commitments, those requirements should be documented in the applicable Statement of Work, Data Processing Addendum, or Security Addendum.

 Because Tyche operates mobile-management capabilities under the customer’s authority, the customer is responsible for:


  • Determining the lawful and appropriate purposes for device administration 
  • Providing legally required notices to employees, contractors, users, or other affected individuals 
  • Obtaining required acknowledgments, consents, or authorizations 
  • Establishing acceptable-use, monitoring, geolocation, and device-management policies 
  • Determining when location tracking, remote locking, wiping, or other administrative actions are appropriate 
  • Ensuring that personal and corporate device-ownership models are configured correctly 
  • Restricting administrative access to authorized personnel 
  • Maintaining current lists of approved administrators and escalation contacts 
  • Defining data-retention, legal-hold, incident-response, and offboarding requirements 
  • Ensuring that instructions provided to Tyche comply with applicable employment, privacy, communications, and laws.


Tyche reserves the right to refuse an instruction that it reasonably believes is unlawful, outside the contracted scope, technically unsafe, or inconsistent with the customer’s documented authorization procedures.
